Data Protection

Pursuant to the Data Protection (Bailiwick of Guernsey) Law 2001 (the "Data Protection Law"), HVPE's administrator, Anson Fund Managers Limited ("AFML") is a Data Controller. AFML will process in accordance with the Data Protection Law any personal data, as defined in the Data Protection Law ("Personal Data"), provided by you to HVPE, and HVPE will not use such information other than in the normal course of business or as allowed by the Data Protection Law. This may include retaining Personal Data on a database or a relevant filing system. Upon receipt of a request to AFML and subject to payment of the statutory fee from time to time, you may be provided with your Personal Data in accordance with the Data Protection Law. HVPE and/or AFML may be required to transfer or disclose Personal Data to a third party, including governmental, regulatory or judicial bodies or agencies, professional advisers or other companies in the same group as HVPE, wherever they are located in the world, during the normal course of HVPE's business provided that the Personal Data may only be transferred to a jurisdiction which is reasonably considered to have data protection laws and regulations equivalent to those existing in Guernsey or to any other jurisdiction if required by law or, in the sole discretion of HVPE or AFML, if it is determined that there is adequate protection for the Personal Data in that jurisdiction.
